Why have I been charged with a number of offenses?

An individual arrested for drunk driving in Minnesota will typically be charged with:

(1) Driving While Impaired (DWI);

(2) Blood Alcohol Concentration (BAC) over .08%;

(3) Blood Alcohol Concentration (BAC) over .08% within 2 hours of driving; or

(4) Refusal to Submit to Testing.

These charges are the various ways of committing a violation under MN. Stat. § 169A. A person can only be convicted of one of the above DWI related offenses and all the others must be dismissed at the time of sentencing.
